These Terms and Conditions govern your use of Enforcify's parking enforcement services and website. By using our services, you agree to these terms.

1. Authority and Authorization

Enforcify is authorised by Waka Kotahi - New Zealand Transport Agency (NZTA) pursuant to section 241 of the Land Transport Act 1998 (Gazette Notice Number 2024-au3232) to issue parking notices on behalf of property owners for parking violations on private property.

2. Parking Notices

Parking notices are issued when:

• A vehicle parks in violation of clearly displayed parking rules
• A vehicle exceeds authorized parking duration
• A vehicle parks without valid authorization or permit
• Any other breach of the property's parking terms

3. Payment Terms

Payment is due within the timeframe specified on the parking notice. Early payment discounts apply when payment is received within 10 days. Late payment may result in additional fees and referral to debt collection agencies.

4. Appeals Process

You may appeal a parking notice within 14 days of issue by providing valid grounds and supporting evidence. Appeals are reviewed within 10 business days. The decision on appeals is final, subject to your right to seek independent resolution through the Motor Vehicle Disputes Tribunal.

5. ANPR Technology

We use Automatic Number Plate Recognition (ANPR) cameras to monitor parking. By parking on monitored property, you consent to your vehicle registration being recorded for enforcement purposes.

6. Liability

Enforcify acts as an agent for property owners. Parking notices are issued on behalf of the property owner. We are not liable for any indirect, consequential, or special damages arising from parking enforcement activities.

7. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services constitutes acceptance of updated terms.

8. Governing Law

These terms are governed by New Zealand law, particularly the Land Transport Act 1998 and the Privacy Act 2020.
